Moderna countered a patent-infringement lawsuit from CureVac. Moderna claims the legal action violates a prior agreement between the two biotech firms. In a Delaware federal court filing, Moderna asserts CureVac agreed not to sue in exchange for assistance in a separate case against BioNTech. Moderna alleges CureVac proceeded with the lawsuit to "harass" the company after BioNTech acquired CureVac.
The countersuit marks the latest development in litigation among mRNA vaccine developers. CureVac initially sued Moderna in April 2026. CureVac claimed Moderna's blockbuster Spikevax vaccine copied its patented technology for stabilizing mRNA. Moderna argues the lawsuit breaches their agreement. Moderna also maintains its vaccine does not infringe on CureVac's patents. Furthermore, Moderna challenges the validity of those patents.
