A New York judge is questioning the jurisdiction of a U.S. class-action lawsuit filed against Coupang Inc. The legal action follows a massive data breach that compromised the personal information of 33.7 million users.

The court expressed skepticism regarding why the case should proceed in the U.S. instead of South Korea, where the e-commerce business primarily operates. Plaintiffs argue the U.S. venue is appropriate because Coupang is a NYSE-listed company with leadership that influences its Korean subsidiary.

Coupang’s legal team contends the Korean operation is a separate entity. They also noted that multiple South Korean authorities are already investigating the matter. The judge has ordered both parties to submit further arguments before deciding whether to dismiss the suit on jurisdictional grounds.
