Australia’s Federal Court rejected BHP Group’s bid to dismiss a major class-action lawsuit alleging the company failed to protect female workers from systemic sexual harassment. The October 23, 2026, ruling allows the case, which covers incidents spanning two decades, to proceed.

Filed on behalf of women who worked at dozens of Australian mining sites, the lawsuit alleges BHP was negligent and knew or should have known about the risk of sexual harassment.

The court struck out minor parts of the claim, but the core allegations of systemic discrimination and harassment will move forward, marking a major legal setback for the mining giant.
